“We” and “Us” is Pets SAS and/or www.petssas.com
“The Customer” and “You” is the customer.
1. Pets SAS is the owner of this website who offers this service to their customers
PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE. BY PLACING AN ORDER WITH PETS SAS YOU AGREE TO THESE TERMS.
Terms & Conditions
1. Format of the contract
i. These terms of sale apply to all goods and services supplied by Pets SAS.
ii. We may change these terms of sale without notice to you in relation to future sales.
iii. These terms and conditions are subject only to UK law.
2. Description and price of the goods
i. The description and price of the goods or services you order will be as shown on Pets SAS website at the time you place your order.
3. Payment
i. Payment for the goods or services and delivery charges can be made by any method shown on Pets SAS website at the time you place your order.
ii. There will be no delivery until cleared funds are received.
4. Delivery
i. The goods you order will be delivered to the address you give when you place your order.
ii. Orders will be sent out usually within fourteen working days.
iii. Orders will be sent by Royal Mail Recorded Signed within the UK or Airmail for International orders, which is paid by the customer at the time of placing the order.
iv. Goods must be checked within seven days from delivery after that time no replacement with be given.
v. Delivery charges are shown on the website and at time of ordering
5. Details to be printed/engraved onto goods
i. It is the responsibility of the customer to give Pets SAS the correct information at the time of ordering to be printed/engraved onto the goods.
ii. Pets SAS accepts no responsibility if the information provided by the customer is incorrect.
6. Your right of cancellation and refunds
i. Due to the nature of the goods, you do not have the right to cancel once you have place an order. This is because the products are personalised items which have been specially produced for you and the items will have a zero marketing value and cannot be resold.
ii. We will however replace an item if it has a defect.
7. Returns Policy
i. No returns are allowed, unless there is a defect with an item.
ii. The defect item cannot be returned unless Pets SAS has been informed and a returns number has been issued and marked on the package.
8. Use of Service
i. Pets SAS shall provide the Service to the Customer on a subscription base.
ii. You will never own the service
iii. Pets SAS will provide you with a Pets SAS ID Email address during the period of the duration of the subscription that has been paid. However, you will never own the Pets SAS ID Email address, as it is the property of Pets SAS.
iv. The Pets SAS ID Email address will be provided to you purely for the use of the Pets SAS ID Tag System, but does not supply you with a personal email address, as it is your responsibility to have your own personal email address.
v. The Pets SAS ID Email address that will be provided to you must not used for:-
a. Subscribing to any other services outside of Pets SAS website.
b. A way of communicating with other services, businesses, people, etc, other-than what it has been setup to be used for to allow the person that has found your pet to be able to contact you.
c. SPAM, aiding and abetting, obtaining illegal items or services, threats, etc.
vi. You accept that any emails that are sent to the Pets SAS ID Email address, Pets SAS will receive a copy. This is to ensure that:-
a. The service is being used in the correct manner.
b. To follow up any problems that may occur.
c. To keep a record of any pet that is found.
d. To keep a check that you are not receiving SPAM that has nothing to do with Pets SAS.
vii. If you do get SPAM through the Pets SAS ID Email address and it is proven it is not caused by you and it gets too much, then we will re-issue you with a new Pets SAS ID Email address, with the understanding that you will be required to pay half the cost of a replacement Pets SAS ID Tag at the price stated on Pets SAS website. This is because we cannot be liable for any SPAM getting through to you, as it is out of our control.
viii. If you do get SPAM through the Pets SAS ID Email address and it is proven it is caused by you, then Pets SAS reserves the right to start the termination procedure between you and us. Please read the rules in the heading “Termination of Contract” below.
ix. By accepting these Terms and Conditions, the customer accepts Pets SAS will test the Pets SAS ID Email address by transmitting an email to the customer through this way every so often.
x. The customer accepts by using this service, they agree to being contacted by the person that finds the registered pet when lost through this system.
xi. Once the customer has been contacted by the person that has found the registered pet, it is upto the customer how to communicate with that person and make provisions for collecting the pet. Pets SAS does not get involve.
xii. If any of the details engraved on the ID Tag changes for any reason, you should inform us of the change if you require a Replacement ID Tag, which will be provided at the rates set out on this web site.
xiii. Consent Statement.
a. By paying to have a Consent Statement placed on your Pet Page, you are saying that in the event of your pet requiring emergency medical treatment when your pet is found, then you give your consent for the treatment if you cannot be contacted beforehand and confirm that you will arrange to pay the fees when you are reunited with your pet.
b. Pets SAS does not guarantee that your request will be seen or be carried out, therefore they are not liable for anything.
c. Pets SAS only provides this information on behalf of you the named
pet owner and if this information is acted on, then it is upto you the pet
owner and the person that acted upon this information to resolve any issues.
9. Provision of Information
i. Pets SAS shall pass on the relevant details to our engravers in-order for the Pets SAS ID Tag to be produced and this will be done by you accepting this agreement as at the time of paying for this service. No other personal information will be given to the engravers other than the details that are to be engraved on the Pets SAS ID Tag..
ii. Pets SAS shall not sell personal details of their customers to other organisations or pass onto any third parties.
iii. In English Law when ask, Pets SAS will be bound to hand over any information that is held by Pets SAS about the customer to an English Court of Law.
10. Liability
Pets SAS offers a paid service to the customer as it describes on the website and nothing more.
11. Termination of contract
i. Either party can terminate this contract during the term giving thirty days notice in writing. No refunds will be given if customer terminates this contract.
ii. If the customer does not follow the terms laid out under paragraph 8 “Use of Service” section “v” and “vii”, then Pets SAS reserves the right to email the customer a warning pointing out these Terms and Conditions. This will be followed by another warning by email if the customer has not stop offending and the customer will be advised that their contract could be terminated. On the third email being sent to the customer, it will be a termination notice informing the customer that their contract has been terminated and the service is no longer available to them.
12. Liability
i. Pets SAS takes no responsibilities for your pet in any way.
ii. Pets SAS shall not get involved in any deputes between the customer and any third party, ie. the person that finds the customer’s pet. Unless it becomes a legal matter, then paragraph 9 “Provision of Information” section "iii" will come into force.
Pets SAS reserves the right to make changes the Terms and Conditions without notice on Pets SAS website, but any changes will not effect the Terms and Conditions for goods or services that have been sold previously.
